TIME'S UP FOR DAYLIGHT SAVINGS TIME IN FLORIDA
Every year we set our clocks forward one hour in the Spring and then set the clocks backwards one hour in the Fall. It seemed pointless to do this in Florida but it was the law so we went along with it. Finally, the Florida legislature overwhelmingly passed a bill to make DST permanent so that we don't have to change the time anymore and allowing it to be daylight later into the evening. See Senate bill S. 2537. Governor Rick Scott signed the bill into law this past March,

PROCESS SERVICE AFTER DARK.
We recently received a subpoena to serve on a witness from an attorney who advised that the witness is notoriously difficult to serve. We made a few attempts during the day and evening and we even posted contact cards on the door in the hopes that the witness would cooperate but there was no answer and the witness never called us back. My server then decided to make an attempt at midnight. My server went back at 12:05 am. He had his court issued identification displayed o

ZIKA MOSQUITOES FIND A NEW HOME IN MIAMI.
As process servers we can serve evictions all day long but this tenant just won't leave! The City of Miami (with little to no help from the Federal Government) kicked out the Zika mosquitoes from Wynwood but then they moved to Miami Beach. The City of Miami Beach began the eviction process of the Zika mosquitoes but before they could finish the job what do you think the Zika mosquitoes did? You guessed it. They just moved to another area in Miami. The Florida Department of

Florida bill provides civil immunity to rescuers who enter a vehicle to save vulnerable individuals
Process servers in Miami are on the road day and night and we know how hot it can get here. It can be jarring. Our beloved basketball team is named the Miami Heat. When visitors come to Miami the heat is the first thing they notice when they get off the airplane. Look at this graph of outside temperature vs inside temperature: At Miami PSPI, we have an office dog that warms our hearts and we all love our little Nina so it concerns us when we see pets locked inside hot car

Before Tinting Your Vehicle Windows, Know The Laws.
In Florida if your tint/sunscreening material is too dark or too reflective you can be pulled over and charged with a non-moving violation pursuant to FL Chapter 316. The penalties for non-moving violations vary slightly from County to County in Florida. In Miami-Dade County the fine is $129.00 and the sunscreening must be replaced with a legal tint/reflectiveness or removed. Otherwise, you may be subject to another fine or worse for repeat offenders. Law enforcement office

Lounging Raccoon Unfazed By Process Server.
Our process servers see a lot of strange things while working out in the field in Miami but this one is too adorable not to post. Last night a Miami PSPI process server, while on duty came across a raccoon lounging by a pool. The server reports that the raccoon was sort of a gangster as it was completely unfazed by his presence. After staring at each other for a while the server left the annoyed raccoon alone so it could resume melting away its worries and stress under the

HOW IS FERGUSON, MISSOURI TODAY?
We have all seen the media reports of the riots, looting and protests in Ferguson, MO since 11/24/2014 when the grand jury decided not to indict Officer Darren Wilson for shooting Michael Brown. How is Ferguson doing now? Some have accused the media of exaggerating the conditions of the streets in Ferguson but we all know the media would never do that for mere ratings. Just to be sure we reached out to the only people we know on the ground level in Ferguson - process serve

CAN I BE SERVED ON CHRISTMAS?
You can't be served on Christmas in Florida if it is 2016, 2022, 2033, 2039, 2044, etc. These are years where Christmas lands on a Sunday. Otherwise, you can be served on Cristmas or any other holiday so long as it is not on a Sunday. In Florida, service is valid any day and time except for service on Sunday. In fact, if someone is served on Sunday, the person who caused the service to occur on Sunday can be held liable to the person served pursuant to Florida Statute 48.20.

LAW CHANGE PROHIBITS SECURITY GUARDS FROM DENYING PROCESS SERVERS UNANNOUNCED ACCESS ONTO PROPERTIES
In America, litigants enjoy the benefit of full and fair trials in state courts but not until the defendant is served. With growing number of gated communities and expensive highly guarded condominiums popping up, access to the wealthy and privileged is unsurprisingly often more difficult than access to those who cannot afford these homes. Few could blame them for living with such private lifestyles but when their ability to live with restricted access extends to process se

SOMEONE ELSE'S ACCIDENT CAN GET YOUR LICENSE SUSPENDED.
In Florida, if you let someone borrow your car and they cause an accident, you are just as responsible as if you were driving the car. In fact, if you evade service or if you can't be served at the address on your driver license because you don't live there anymore, the State of Florida will accept service on your behalf. The Plaintiff can then proceed to judgment and your license will be suspended until the debt is paid in full. In many cases the the Plaintiff may accept p
